Within the first 90 days after sentencing (intake phase), your Probation Officer will conduct a risk assessment, which will determine how often they see you. During the intake phase, clients are required to be seen by the Probation Officer every 2 weeks. After the intake phase, you could be required to report as little as once every six months or as frequently as once a week. Reporting includes office visits, home visits, school visits, and employment visits. Your Probation Officer will communicate with you how often you will be required to report.

A cognitive behavioral treatment strategy that focuses on a step-by-step approach. Clients in MRT will receive a workbook that they will complete as they work through the program. Most MRT groups consist of 12 steps, and steps 13-16 are completed on an as need basis. Most MRT groups can be completed within three to six months and are considered open groups, which means that clients can start whenever they are ordered to do so. MRT is self-paced, but clients are expected to be working on their step work in between groups. When in MRT, clients are held accountable for their actions and may have to repeat steps if deemed appropriate. All MRT groups take place in person at the Probation department, except DUI MRT and Diversion MRT, which take place on Zoom.

A Victim Impact Panel is a group of victims and/or family members of victims who share their experiences after being affected by impaired drivers. The purpose of the Victim Impact Panel is to help DUI clients recognize the lasting and long-term effects of driving under the influence.

Once the VIP is completed, a certificate will be generated which must be shared with your Probation Officer/Court Monitoring staff member.

Adult

If you live in a different state, your case may or may not be eligible for a transfer to that state based on certain criteria. Transferring out of state is based on federal laws, and while McHenry County controls the decision of whether or not to transfer a client under the Interstate Compact, the receiving state has no discretion as to whether or not to accept the client’s case as long as the client satisfies the criteria. Transfers out of state fall into one of two categories, mandatory and discretionary. Clients must meet with their McHenry County Probation Officer to sign an application to start this process and the transfer process and take up to 6-12 weeks. Some clients may be required to remain in Illinois until the receiving state approves the transfer.

Juvenile

If the juvenile’s guardian lives in another state, your case may transfer.  McHenry County will still have judicial authority in the case.

If you live in a different County in Illinois, your case will be transferred to that jurisdiction for supervision. You must meet with your McHenry County Probation Officer after you are initially sentenced, and the Probation Officer will obtain information and verification of your current residence to start the transfer process. Clients are required to maintain bi-weekly phone calls with their McHenry County Probation Officer until their case is officially transferred. Special conditions ordered by the Judge may require some clients to report over the phone more often or in person. The transfer process can take 6-8 weeks. McHenry County will still have judicial authority in the case.

The amount of drug tests that you will be required to take depends on your Court order, the type of Probation you are on, your risk level, and other factors. Your Probation Officer will explain the process to you once you are sentenced or at any time you need clarification. Drug testing is completed by a third-party vendor within the McHenry County Probation and Court Services department. The sentencing Judge may order clients to not use THC or alcohol while on probation or supervision. Clients must notify the Probation Officer/Court Monitoring staff member of any prescriptions that are currently prescribed.

Yes. If you are convicted (adult court) of a felony, adjudicated (juvenile court) of a felony or a Judge orders it to be taken.

Yes, if:

• A person is convicted of a felony under the laws of the State of Illinois or any other jurisdiction
• A person who has been convicted within the past five years of battery, assault, aggravated assault, violation of an order of protection or a substantially similar offense in another jurisdiction, in which a firearm was used or possessed
• A person who has been convicted of domestic battery, or a substantially similar offense in another jurisdiction committed before or after January 1, 2012
• A minor subject to a petition filed under Section 5-20 the Juvenile Court Act of 1987 alleging that the minor is a delinquent minor for the commission of an offense that if committed by an adult would be a felony
• An adult who had been adjudicated a delinquent minor under the Juvenile Court Act of 1987 for the commission of an offense that if committed by an adult would be a felony

To travel outside the state, your Probation Officer must be notified in an appropriate amount of time and approve of the travel permit. The travel permit can be completed in person with your Probation Officer, or you can visit our Probation Officers page and select your Officer and then select Travel Permit, and once completed it will email it to your Officer.

If you are looking to travel outside of the Country, you will need to appear before your sentencing Judge to receive permission. Your attorney can help you with this process.

Travel requests are not guaranteed to be granted and will be dependent on your compliance on Probation.

Probation and Court Services can provide bus passes through the MCRide Dial-A-Ride program in partnership with Pace Bus. Your Probation Officer can distribute single, one-way, bus passes upon request.

MCRide service operates every day, except for holidays, from 5:00 am to 11:00 pm. The fares for the general public are $4.00 for the first five miles. Fares for seniors (60+) and individuals with a disability are $2.00 for the first five miles. All riders are charged $0.25 per mile after the first five miles.
