APPARENT CONFORMITY STATEMENT FROM THE MCHENRY COUNTY CLERK

The McHenry County Clerk’s Office conducts an apparent conformity review of all nominating petitions submitted for filing therewith and will be limited to checking for the following:

  1. Securely fastened pages
  2. A signed, notarized Statement of Candidacy,
  3. Submitted nominating sheets containing:
    1. Gross signatures equal to or exceeding 10% of the minimum number of signatures required for the office sought
    2. Notary on each page
    3. All pages sequentially numbered

All candidates whose petitions fail the apparent conformity review at the time of submission will be verbally notified and given the opportunity to leave their place in line to remedy the issue(s) identified and allowed to return later within the filing period to submit their remediated petition package.

If the candidate chooses to ignore the issues identified by the Clerk’s Office and insists that the petition be filed as presented, the office will oblige the candidate and accept the petition. Further review may be conducted by Clerk’s Office staff. If that further review leads to a determination that the petition is nonconforming, the candidate will be notified and given the opportunity to appear before the Electoral Board at its first meeting held to call petition objection cases before a determination is made to reject the petition.

Please note that leaving your place in line to address petition deficiencies could affect ballot placement, as filing order is determined by the date and time the candidate’s petition is successfully filed with the office.

Passing the apparent conformity review does not guarantee that the candidate’s submission is accurate, complete, endorsed by the Clerk’s office, or is in any way exempt from further challenge or objection.
