New Access Ordinance, Procedures Manual and Permit Fees

Note: McHenry County has a new Access Management Ordinance titled "McHenry County Access Control and Right-of-Way Management Ordinance". This Access Ordinance, adopted by the McHenry County Board on November 6, 2008, went into effect on January 1, 2009 and replaces the older Access Management Ordinance that was adopted March 18, 1997. In addition to the new Access Ordinance there is now a "McHenry County Division of Transportation Permit Procedures and Requirements Manual". This Manual provides application forms, construction standards/requirements, exhibits and guidance on the permitting process and acts as a supplemental guide to the Access Ordinance. There are also new permit fees that went into effect on January 1, 2009. Permit fees are due at the time of permit application. For some projects and locations a pre-application meeting with DOT staff is required (see Access Ordinance for details). Developer Permit Projects Construction Cut-Off Date for 2011

If you have a developer permit project involving access and road work on a County Highway that has received written permit approval from the McHenry County Division of Transportation (MCDOT) and the work will start or is required to be built in 2011, then the access and road work on the County Highway shall start no later than October 14, 2011 or sooner if an earlier date for completion was required by the MCDOT, for the 2011 calendar year paving/construction season. If you cannot meet this deadline then the start of the access and road construction must wait until work can begin in 2012 (typically beginning in April) unless otherwise instructed or approved by the MCDOT. This deadline is necessary to allow time for the road improvements to be completed in 2011 taking into account possible delays caused by Fall inclement weather and asphalt plant closings typically on or near November 15. The no later than date could be sooner, if required by the County Engineer, depending on the scope of the project.
